Commissioning/purchase of a public-facing 'Webserver as a Service' provided as a service by promarketing365 grants you a revocable, non-transferable and non-exclusive license to avail of and use the supplied website server and it’s content system delivered through or via the content sections of the website and/or associated domain names (the "services") in accordance with these Terms of Service (the "licence") issued by promarketing365 at or after the time of commission.
Limited Usage Granted
You are licenced to use the supplied web services on promarketing365 servers only and not on third party servers/systems. After your hosting/service expires with remittance pending your server/system may be suspended without further notice and without recourse to compensation. Access to FTP, SSH, Telnet and/or panel services are strictly prohibited by third parties unless obtained expressly in writing.
Assignability
You may not sub-license, assign, or transfer this license to anyone else without prior written consent from promarketing365.
Ownership
Our services and products are provided “as is” without warranty of any kind, either expressed or implied. In no event or circumstances shall promarketing365 be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products or services. Additionally, all software, licences and intellectual properties and their derivatives remain the property of promarketing365 at all times.
Use of Content
You acknowledge that you are responsible for content and material (collectively the “Content”) provided to us for use on your website which may be protected by copyright, trademark or other proprietary rights. Content data and/or media are the property of and available to you, the website operator, at all times. This does not affect your statutory rights.
Refund policy
Since promarketing365 is offering non-tangible goods and services and once commissioned such services consume resources we do not issue refunds for services rendered, development works carried out or third-party services or resources commissioned or otherwise secured, which you are responsible for understanding prior to any payment being made.
Warranty
promarketing365 expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of title, merchantability including, but not limited to merchantability of computer programs, and fitness for a particular purpose. promarketing365 does not warrant or guarantee web servers in any manner once the server is deployed in a live capacity. We cannot guarantee the server will function with all browsers or browsing engines. Browser compatibility should be tested against the demonstration websites on the intended platform(s). Nothing in this section should be construed as excluding or limiting any warranty beyond what is permissible under applicable law.
Support
promarketing365 offers these websites and styles "as is", with no implied meaning that they will function exactly as you wish or with all 3rd party devices, operating systems or browsers.
promarketing365 expressly disclaims all liabilities relating to third party illegal or unethical activities that interfere with the operation of your website and/or may cause your server’s resources to be misappropriated for illicit or unusual activities.
promarketing365 & 'websaas' services expressly exclude support for changes, modifications or alterations to the content or other parameters on the server that are carried out by agents or any other entities on behalf of the domain name and/or website owner that may cause the server or webserver to malfunction or operate in an abnormal manner whether by force majeure or not.
You acknowledge by your use of the promarketing365 services that it is at your sole risk, and that you assume full responsibility for all costs associated with all necessary servicing or repairs in connection with the operation of the website hosting server under you domain name.
promarketing365 reserves the right to change the Terms of Service from time to time. Further, promarketing365 reserves the right to modify or discontinue any portion of the services or products advertised on our website. promarketing365 shall not be liable to you or any third party should promarketing365 exercise its right to modify, suspend, limit or discontinue any services or products.
